The Five Bar Association Rules for Governing Client Finance

No Compensation Other Than Collection Of Legal Fees - Attorney may not receive compensation in any form beyond receipt of their legal fees and recovery of actual costs (such as credit card fees) as a result of the transaction. All costs to the consumer are paid exclusively to the lender and not compounded by also paying a broker fee to provide a service to the firm. - ePay Management, LLC is not a broker and we receive no compensation from the borrower nor the lender in any form whatsoever.

Arm's Length Transaction - Attorney may have no formal or informal relationship with the lender. - Our company is not a lender nor broker and functions solely as a concierge for client by providing a group of competing lenders otherwise unavailable except as each lender appears individually and independently online. Client firms have no relationship of any nature with its platform lenders.

Fair Market Pricing - Attorney must assure the reasonable expectation a potential client will receive treatment consistent with "Fair Market Pricing" from any referred source. - Fair market pricing is assured by the competitive nature of our platform - multiple lenders place their best possible offers based on the applicant's credit profile and debt-to-income ratio consistent with each lender's underwriting criteria. Client has the ability to choose from multiple offers in many cases.

What You Need To Know About EMV

EMV is a security framework that defines the payment interaction at the physical, electrical, data and application levels between chip cards and payment devices. These interactions are often referred to as EMV Level 1 and 2 requirements. EMVCo was created by the payment networks to be a neutral party in making this standard framework.

How Does It Work?

Smart cards are embedded with a chip that is encrypted with data. EMV-enabled devices have the ability to read data stored on a chip within the card. During the transaction authorization process, strong cryptographic functions are used to validate the authenticity of the card and cardholder.
Best of all, when a customer pays using an EMV-enabled device, the device is instantly identified as an authentic, approved payment instrument through a process called dynamic authentication. When used with a PIN, the chip proves that the customer is paying with his or her own card.
By using chips as an active part of the payment transaction, EMV cards and devices help prevent credit card fraud from stolen account numbers and cloned payment cards.
Solutions
The complexity of migrating to EMV chip-card standards can pose significant challenges for acquirers and merchants. ePay Management is currently offering Verifone EMV-compliant solutions for all counter top environments. Fraud Liability
Today, if an in-store transaction is conducted using a counterfeit, stolen or otherwise compromised card, consumer losses from that transaction fall back on the payment processor or issuing bank, depending on the card's terms and conditions.
After an Oct. 1, 2015, deadline created by major U.S. credit card issuers MasterCard, Visa, Discover and American Express, the liability for card-present fraud will shift to whichever party is the least EMV-compliant in a fraudulent transaction.
Consider the example of a financial institution that issues a chip card used at a merchant that has not changed its system to accept chip technology. This allows a counterfeit card to be successfully used.
"The cost of the fraud will fall back on the merchant," Ferenczi says.
The major credit card issuers each have published detailed schedules about the upcoming shift in liability. The change is intended to help bring the entire payment industry on board with EMV by encouraging compliance to avoid liability costs.
Any parties not EMV-ready by October 2015 could face much higher costs in the event of a large data breach.
Automated fuel dispensers will have until 2017 to make the shift to EMV. Until then, they will follow existing fraud liability rulings.

Analog Credit Card Terminals and Digital / Voice Over IP (VoIP) Phone Service



As the popularity of digital and VoIP phone service in today’s business market grows, so do the communication issues with analog machines. As a payment-services, sales professional it is imperative that you are aware of the issues relative to analog equipment and newer digital phone lines to be able to recommend the appropriate alternative solutions.


Analog credit card terminal modems run on an analog frequency that is much slower than a typical digital phone line frequency. Analog equipment has difficulty communicating over the static, line noise and echoes caused by the vast frequency difference between itself and a digital phone line. Ultimately, duplicate transactions, multiple authorizations, transactions that never get processed and modems that wear themselves out are common results. Not-to-mention the initial download of the machine can be a problem.


In many instances, persistence or a DSL filter have become acceptable “work-arounds” for the problem and merchants with analog equipment and digital phone service continue to process. An issue that most merchants and many sales offices are unaware of is that utilizing a PCI Compliant terminal with a standard VoIP connection deems their processing “Non-compliant” with PCI standards.


A PCI Compliant terminal with encrypted VoIP may be compliant if the connection meets requirements of all published Visa and MasterCard (and any other types of cards that you are going to swipe) data security rules, including encryption and firewalls. This issue is obviously not limited to new business. Existing merchants who have upgraded their analog phone systems to digital are also experiencing frustration with this problem and should be informed of the issues and given the proper options for resolution.


So what are the options? The easiest, but not necessarily the least expensive, solution is to replace the old, analog credit card terminal with an IP-capable device running over an Ethernet connection. Examples of acceptable devices would include the Verifone Vx510 Dual-Comm (both 6 mb and 12 mb) unit or the Vx 570 DC terminals. In some instances it may make sense to suggest a wireless solution such as the Verifone Vx610, PAYware Mobile or Charge Anywhere products. Finally, in others instances a PC-based virtual terminal or client side software solution with a USB mag-card reader may be the best choice.
